Future NY Times suit?

Wizbang and others report that New York Republican Congressman Peter King wishes to prosecute the NY Times on it's disclosure of secrets.  Unsurprisingly, Senator Arlen Spector isn't so sure about that.

Austin Bay takes another perspective: "The Bush Administration should prosecute the leakers, but I don’t think the Administration has the spine for this. The Bush Administration could barely prosecute Sandy Berger for abuse of classified material that would have put a solder in jail."

My personal opinion is why not both?  Prosecute the leakers for leaking state secrets, and the NY Times for publishing state secrets.  Folks in both places should think twice (or more) before they endanger even one soldier, sailor, airman, or marine.
